Dividing property and debt

Community property versus equitable distribution — and what counts as separate property.

Community property states

Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, and Wisconsin generally treat property acquired during marriage as owned equally.

Equitable distribution states

All other states divide marital property fairly, which is not always equally, based on factors like income, contributions, and the length of the marriage.

Separate property

Property owned before marriage, inheritances, and gifts to one spouse are often separate — unless they were mixed with marital assets.
